This privacy policy describes the information the App-Nea and its affiliates (“Company”) collects about you though our websites and all other services we provide (collectively, the “Services”), how we share that information, and the privacy choices we offer. This policy applies to information we collect when you access our websites (collectively, the “Site”), when you use our Services or when you interact with us.

App-Nea designs and markets the App-Nea workflow platform system which enables users to track and share progress whilst undergoing oral appliance therapy for the treatment of mild to moderate sleep apnea by uploading images, sharing stories, creating appointment reminders and receiving notifications (the “App”). The following discloses how we collect, use and share the information we gather on our websites and App (collectively, the “Sites”).

By using our Site, you consent to our collection, use and disclosure, transfer and processing of Personal Information in accordance with this Privacy Policy.

Children under 13 are not permitted to use the Service, and so this privacy policy makes no provision for children's use of the site.

Confidentiality of Health Information

Health information that the Company receives and/or creates about you that identifies you personally and relates to your past, present, or future health, treatment, or payment for healthcare services, may be “protected health information” under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the Health Information Technology for Economic and Clinical Health Act (“HITECH Act”). Your health information may also be protected by state privacy and laws and regulations.

The Company understands that health information about you and your health is personal. We support your privacy and make sure that the transmittal and use of your health information complies with all laws. In this regard, where applicable, we comply with HIPAA, HITECH, and other relevant state laws and regulations by entering into Business Associate Agreements with the healthcare providers for which we provide services to ensure that your protected health information is appropriately safeguarded. This Privacy Policy does not address how healthcare providers will use and disclose your health information. Each healthcare provider has its own Notice of Privacy Practices. If you have questions about the privacy of the information collected by the healthcare providers who provide services to you, please ask them for a copy of their Notice of Privacy Practices.

Information We Collect from Your Use of the Services

We collect Personal Information of customers, patients (former, potential and current), patients’ parents/guardians, physicians, and website visitors when you visit our Site, register to become a member of our Site or via on-line forms when you download and use App-Nea. Such information may include your name, address, telephone number, email address, IP Address or other persistent identifiers, geolocation, date of birth or age, gender, credit card and other financial information, photographs and other information you choose to provide. In addition, when visiting our Site we may collect sensitive data about you such as health information including images of your mouth and airway. Users of the Site may also have information about their oral appliance therapy stage, scheduled appointments, and treatment progress shared with their treating doctors.

• Cookies: “Cookies” are small computer files transferred to your computing device that contain information such as user ID, user preferences, lists of pages visited and activities conducted while using the Services. We use Cookies to help us improve or tailor the Services by tracking your navigation habits, storing your authentication status so you do not have to re-enter your credentials each time you use the Services, customizing your experience with the Services, and for analytics and fraud prevention.

A session ID cookie will get removed automatically when you close your Web browser. We may use session cookies to make it easier for you to navigate our website. A persistent cookie remains on your hard drive for an extended period of time. We may also set a persistent cookie to store your passwords, so you don’t have to enter it more than once if you so choose. We have cookies on our Site but the data is only collected in the aggregate.

App-Nea may send you service-related announcements when it is necessary to do so. For instance, if our Service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.

What do we do with the information we collect?

We use your Personal Information for a variety of business purposes, including:

•To set up and otherwise manage your member account on our Sites.
•To provide you with information about our services, news and events that may be of interest to you.
•To provide details of physicians/dentists and their practices and submit contact requests to them
•To provide dentists and physicians with information on actual or prospective patients
•To provide a communication platform for your treating doctors who enrolled you into App-Nea, with information about your oral appliance therapy treatment stage, scheduled appointments and treatment progress.

Information sharing and disclosure

The Company may be required to disclose personally identifiable information or protected health information under special circumstances, such as to comply with subpoenas or when your actions violate the App-Nea Terms of Use.

The Company may share demographic information with business partners, such as "10% of App-Nea customers are in the New York tri-state area" or the like. No personally identifiable information or protected health information will ever be used without your permission (i.e., we will ask you before using a quote or testimonial).

The Company does not rent, sell, or share personal information about you with other people or nonaffiliated companies for promotional purposes except to provide products or services you've requested or when we have your permission.

With your consent, we do share your name and email with certain partners we may work with. If you would not like your information shared with these partners, uncheck the box when asked this option or notify us via info@app-nea.com.

It may be necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Company’s Terms of Use, or as otherwise required by law. We will transfer information about you if the Company is acquired by or merged with another company. In this event, The Company will notify you by email or by putting a prominent notice on the App-Nea website before information about you is transferred and becomes subject to a different privacy policy.

We use other third parties such as a chat service provider to provide customer service to you, and a credit card processing company to bill you for goods and services, an email service provider to send out emails on our behalf. When you sign up for these services, we will specify what personally identifiable information is being shared as necessary for the third party to provide that service.

Users of App-Nea whose treating physician or dentist enroll them in, and who accept the Remote Care function of the App may also have information about their oral appliance therapy treatment stage, scheduled appointments and treatment progress shared with their treating doctors. To un-enroll in the Remote Care feature of the App, please contact your treating doctor.

Retain your personal information

We will retain your information for as long as your account is active or as needed to provide you Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

International Data Transfers

App-Nea operates globally and may therefore transfer your personal information to other countries in which App-Nea operates, including countries other than your country of residence. We will continue to protect your information in accordance with this Privacy Policy and our Data Protection Policy. By providing us your personal information, you agree to such transfers, processing and/or storage anywhere in the world, including the U.S.

Security

The security of your personal information is important to us. When you enter sensitive information such as credit card number on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). While we follow generally accepted industry standards to protect the personally identifiable information submitted to us, both during transmission and once we receive it, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We post customer testimonials, comments and reviews on our website which may contain personal information. We do obtain the customer's consent to post their name along with their testimonial via email prior to posting the testimonial. You should be aware that any personal information you submit on blogs on this site and others can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages.
